Patentability/Novelty Search

A Patentability/Novelty Search is conducted to evaluate the patentability of an invention. The objective of a Patentability Search is to identify patent and non-patent literature to determine whether the invention is novel and non-obvious. Search results of Patentability/Novelty Search also helps in drafting the patent application.

Invalidation/Validation Search

Invalidation search is conducted by a defendant to invalidate a patent whereas validation search is carried out by assignee/plaintiff after the grant of a patent to ensure the validity of the patent by conducting prior art search. The objective of the Invalidation Search is to find the prior arts, that enable you to challenge the novelty or non-obviousness of the subject patent. An Invalidation/Validation Search involves conducting a patent and non-patent literature search to identify the prior arts predating the effective filing date (or priority date depending on the case requirements) of the subject patent.

Freedom To Operate Search

Freedom To Operate Search is also termed as FTO search or clearance search. FTO search is carried out to identify the alive patents/pending applications that can be potentially infringed when a product is launched in the market. FTO search is a claim specific search and requires extensive and thorough analysis of claims to uncover all relevant patents in respective jurisdictions. FTO search is restricted to a specific jurisdiction, however, international applications which can enter the target jurisdictions must also be searched.
